CUVR is powered by Shopify, which enables us to provide the Services to you.         Usage Information: Information regarding your interaction with the Services, including how and when you interact with or navigate the Services, and your interactions with QR codes on our products.

        Form Submission Data: Any information you voluntarily provide through forms on our website, including contact forms, artist inquiry forms, or feedback submissions.

        User-Generated Content: Photos, images, videos, reviews, ratings, comments, testimonials, and any other content you voluntarily submit to us or post on or through the Services, including images of our products in use.

        From our service providers, including when we engage them to enable certain technology (such as Twilio for SMS messaging) and when they collect or process your personal information on our behalf.

3. How We Use Your Personal Information

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

3.1 Provide, Tailor, and Improve the Services

We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges, or other transactions, to create, maintain, and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases.

3.2 SMS/Text Message Communications

If you opt in to receive text messages from us, we may use your mobile phone number to send you transactional messages (such as order confirmations, shipping updates, and delivery notifications) and, where you have separately consented, promotional and marketing messages about our products and services. We use third-party service providers, which may include Twilio and/or Quo, to deliver SMS/MMS messages. Your information is shared with these providers solely for the purpose of delivering text messages to you and is governed by their respective privacy policies.

By opting in to receive text messages, you expressly consent to receive recurring automated marketing and transactional text messages at the mobile number you provided. Consent is not a condition of any purchase. You may revoke your consent at any time by texting STOP.

4.3 Artists, Creators, and Intellectual Property Owners

Important: When you purchase products from our store that are associated with a particular artist, creator, brand, or intellectual property owner (each, a “Content Partner”), we may share your personal information—including your name, email address, phone number, shipping address, and full purchase history related to that Content Partner’s products—with the applicable Content Partner or their authorized management and representatives.

5. SMS/Text Messaging Terms and Compliance

This section provides additional terms that apply specifically to our SMS/text messaging program.

5.1 Consent and Opt-In

By providing your mobile phone number and opting in through our website, at point of sale, or through any other method we make available, you consent to receive recurring automated text messages from CUVR at the mobile number you provided. You understand that consent is not required as a condition of purchasing any goods or services. You may opt in to receive one or more of the following types of messages:

        Transactional messages, including order confirmations, shipping and delivery updates, and account notifications.

        Promotional and marketing messages, including product announcements, sales, special offers, and event notifications related to CUVR and our Content Partners.

5.2 Message Frequency and Charges

Message frequency varies based on your interactions with us and the types of messages you have opted in to receive. Standard message and data rates from your wireless carrier may apply. CUVR is not responsible for any fees charged by your wireless carrier.

5.3 Opt-Out

You may opt out of receiving text messages at any time by replying STOP (or UNSUBSCRIBE, CANCEL, END, or QUIT) to any text message you receive from us. After you opt out, you will receive a single confirmation message, and we will not send you any further text messages unless you opt in again. Opting out of text messages will not affect your ability to receive email communications or use the Services.

5.5 Supported Carriers

Our SMS program is supported by most major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.

5.6 No Sharing for Third-Party Marketing

We will not sell, rent, or share your mobile phone number or SMS opt-in data with third parties for their own marketing purposes. Information collected through our SMS program will only be used as described in this Privacy Policy and in compliance with the Telephone Consumer Protection Act (TCPA) and other applicable laws.

6. Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you.

In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes.

We may share personal information with third-party advertising partners in ways that may constitute a “sale” or “sharing” under the CCPA/CPRA. You may opt out of this by using the “Do Not Sell or Share My Personal Information” link on our website. We also honor the Global Privacy Control (GPC) signal as a valid opt-out request for the device and browser from which the signal is sent.

If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted. As of the effective date of this Privacy Policy, we do not have actual knowledge that we “sell” or “share” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

12. Data Sharing with Content Partners

As described in Section 4.3, when you purchase products associated with a particular Content Partner, we may share your personal information with that Content Partner. This section provides additional details about how that information may be used.

        Purpose: Content Partners receive customer data to better understand their audience, to communicate with fans about upcoming releases, events, and merchandise (subject to applicable law and your communication preferences), and to improve the products they offer.

        Scope of Data Shared: We may share your full customer profile, including name, email address, phone number, shipping address, and complete purchase history as it relates to that Content Partner’s products.

        Your Choices: If you do not wish for your information to be shared with Content Partners, you may contact us before or after making a purchase. Please note that opting out of Content Partner data sharing may limit certain features or communications related to those products.

        Content Partner Obligations: Content Partners who receive your information are contractually required to use it only for the purposes described above and in compliance with applicable privacy laws. Content Partners may not sell your personal information to unrelated third parties.

13. QR Code Data Collection

Our products may include QR codes that, when scanned with your mobile device, direct you to digital content, product information, authentication pages, or other experiences related to the Services. When you scan a QR code on or associated with our products, we may automatically collect the following information:

        Geolocation: Your precise or approximate geographic location at the time of the scan, derived from your device’s GPS, Wi-Fi, cellular network, or IP address.

        Device Information: Your device type, operating system, browser type, screen resolution, and unique device identifiers.

        Time and Date: The date and time of each scan.

        Scan Frequency: How often you or others scan a particular QR code.

We use this data to understand how and where our products are being engaged with, to improve the customer experience, to verify product authenticity, and to provide relevant content. This data may also be shared with the applicable Content Partner (as described in Sections 4.3 and 12) so they can better understand how and where their products are being used by fans and customers.

Your Choices: Scanning a QR code is voluntary. If you do not wish to share your location data, you can decline location permissions on your device when prompted, or you can choose not to scan the QR code. Even if you decline location permissions, we may still collect approximate location information based on your IP address.

14. User-Generated Content

We may offer features that allow you to submit, upload, or post content on or through the Services, including product reviews, ratings, photos, images, videos, comments, testimonials, and other materials (“User-Generated Content” or “UGC”). UGC also includes content you post on third-party social media platforms that tags, mentions, or references CUVR or our Content Partners (for example, tagging @CUVR in a post featuring one of our products). This section describes how we handle UGC.

14.1 What We Collect

When you submit UGC, we may collect the content itself (including any metadata embedded in photos or videos, such as location data or timestamps), your name or username, your email address, and any other information you include in your submission.

14.2 How We Use UGC

By submitting UGC to us, you grant CUVR a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, display, distribute, and create derivative works from your UGC in connection with the Services, our marketing and advertising efforts, our social media channels, and any other business purposes. We may use your UGC to:

        Display your review, photo, or testimonial on our website or product pages.

        Feature your content in our marketing materials, email campaigns, social media posts, or advertisements.

        Repost, clip, reshare, or create derivative works from social media content in which you tag or mention CUVR or our Content Partners.

        Share your content with the applicable Content Partner for their own promotional use in connection with their products sold through our platform.

        Improve the Services and develop new products or features.

14.3 Public Visibility

Please be aware that any UGC you submit may be made publicly visible on the Services. Do not include personal information in your UGC that you do not want to be publicly available. We are not responsible for any personal information you choose to include in your UGC submissions.

14.4 Removal Requests

You may request the removal of UGC you have submitted by contacting us using the information in the Contact section below. While we will make reasonable efforts to remove your content from the Services, please be aware that cached or archived copies of your UGC may persist, and content that has been shared with or republished by Content Partners or other third parties may not be within our control to remove.

14.5 UGC from Minors

We do not knowingly collect UGC from children under the age of 16. If you are a parent or guardian and believe your child has submitted UGC to us, please contact us immediately so we can remove it.

15. International Transfers

Our Services are intended primarily for users in the United States. If you access the Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where our servers are located and our central database is operated. By using the Services, you consent to the transfer of your information to the United States.

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons.
